Washington Splits Its Rules: Texts Under CEMA, Calls Under RCW 80.36.390

Some states fold texts into one telemarketing law; Texas did it with SB 140, as our Texas GoHighLevel page explains. Washington does not. Commercial texts fall under the Commercial Electronic Mail Act, chapter 19.190 RCW. Meanwhile, live and recorded sales calls fall under the telephone solicitation statute, RCW 80.36.390.

That split matters for a GHL account, because the two laws ask for different things. A GoHighLevel agency Washington businesses hire has to configure SMS, email and calling as three separate compliance tracks.

A closer look

CEMA and Commercial Text Messages

Under RCW 19.190.060, a person doing business in Washington may not send, or help send, certain commercial texts. The rule covers a commercial electronic text message to a cell number assigned to a Washington resident. The main exception, in RCW 19.190.070, covers texts to someone who "clearly and affirmatively consented in advance" to receive them.

The legislature treats a violation as an unfair or deceptive act under the Consumer Protection Act. You can read the full chapter on the Washington Legislature's CEMA page.

The Legislature revisited CEMA in its 2026 session (ESHB 2274), including the statutory damages available to recipients. Check the current text of RCW 19.190.040 before relying on any dollar figure. The amount and the date it applies from matter for any pending claim.

Lower damages do not change the rule itself. Without advance, affirmative consent, a promotional text to a Washington cell number is still a violation. So a GoHighLevel agency Washington clients trust still builds consent first.

Email Subject Lines After Brown v. Old Navy

CEMA also governs commercial email. In Brown v. Old Navy, decided April 17, 2025, the Washington Supreme Court read RCW 19.190.020 broadly. It bars any false or misleading information in a commercial email's subject line, including claims about how long a sale lasts.

The 2026 session also revisited the subject-line rule, so confirm the current wording of RCW 19.190.020 with counsel. Either way, a GoHighLevel agency Washington retailers use should check "ends tonight" or "last chance" subject lines. Those claims in GHL email campaigns must be true when they go out.

Phone Solicitation Rules Under RCW 80.36.390

RCW 80.36.390 sets the main rules for live and recorded sales calls in Washington. This table shows what the statute says on identification, ending the call, do-not-call requests and calling hours. The last column shows how we handle each rule in GHL.

Calling rule

What the statute says

How we handle it in GHL

Identification

Give your name, the company's name and the purpose of the call within the first 30 seconds

Call scripts and AI voice greetings that open with business name and reason

Ending the call

End the call within 10 seconds if the person wants to end it

Agent coaching notes and short, polite exit lines in call scripts

Do-not-call requests

Tell the person they are removed from your lists for at least a year. Then do not call again or pass on their details

Call DND switched on and an internal note recorded on the contact

Calling hours

No calls received before 8 a.m. or after 8 p.m. at the recipient's local time

Pacific-time account with an 8-to-8 window on call steps

Federal registry

No solicitations to numbers on the federal do-not-call registry

Cold lists checked before import; only consented or customer contacts dialed

The statute excludes calls made at the person's request, calls about something they bought from you in the past 12 months, and business-to-business contacts. Callbacks to inbound leads who asked to hear from you often fit those exclusions; cold outbound prospecting does not.

Health Data: When the My Health My Data Act Reaches Your CRM

Washington's My Health My Data Act, passed as HB 1155 in 2023, protects consumer health data. The Attorney General explains that it covers information identifying a person's physical or mental health status. That includes health inferences drawn from other data, such as an app tracking symptoms.

Regulated entities had to comply with the main sections by March 31, 2024, and small businesses by June 30, 2024. The Attorney General's guidance says collecting or sharing this data needs the consumer's consent. Selling it needs a valid signed authorization, and any violation is a per se Consumer Protection Act violation.

For med spas, clinics, wellness studios and fitness businesses, that shapes the CRM. We keep health questions off general lead forms, limit who can see sensitive fields, and avoid sending health details to ad platforms. A GoHighLevel agency Washington clinics hire should treat these limits as part of the build, not an add-on.

How We Set Up a GoHighLevel Agency Washington Account

Here is how we set up a GoHighLevel agency Washington account before any campaign runs. We add advance SMS consent and separate opt-out tracks for each channel, then review promotional email subject lines. Health-data limits and carrier registration complete the setup.

Advance SMS consent

a clear, unchecked opt-in for marketing texts on every form, calendar and funnel step, with the date and source stored on the contact.

Separate channel tracks

SMS, email and call opt-outs handled per channel in GHL, so a call request to stop does not silently leave texts running.

minimal intake questions for clinics and wellness brands, with sensitive details kept out of marketing workflows.

Pacific Time, Puget Sound and the Rest of the State

All of Washington is on Pacific time, which puts your leads two hours behind Central-time clients and three behind Eastern. If your GHL account is set to your own home timezone instead, morning sends can reach Washington contacts before 8 a.m.

We work with businesses across the Seattle-Tacoma-Bellevue area, Spokane, Vancouver and the Tri-Cities. The Department of Commerce names key sectors including aerospace, information and communications technology, and life sciences and global health. Maritime, clean technology and agriculture and food manufacturing are on the list too. Our Washington clients are mostly clinics and med spas, home services, construction trades and tech-adjacent service firms.

GoHighLevel USA has no Washington office; we are a remote GoHighLevel agency Washington businesses work with by video call. Compare states on our locations page or see our done-for-you GoHighLevel setup. This page is general information, not legal advice. So confirm with your own counsel how CEMA, RCW 80.36.390 and the My Health My Data Act apply to you.

Does Washington's CEMA apply to text messages?

GoHighLevel USA

Yes. RCW 19.190.060 bars sending or helping send a commercial electronic text message to a cell number assigned to a Washington resident. The main exception covers people who clearly and affirmatively consented in advance, so we collect that consent before any promotional texts from GoHighLevel.

What changed in Washington's CEMA in 2026?

GoHighLevel USA

Washington lawmakers amended CEMA in the 2026 session through ESHB 2274, which addressed recipient damages and misleading email subject lines. Check the current RCW 19.190 text for the exact figures. The rule that commercial texts need clear, advance consent did not go away.

What did Brown v. Old Navy decide?

GoHighLevel USA

In April 2025 the Washington Supreme Court held that CEMA bars any false or misleading information in a commercial email's subject line, not only misstatements about the email being an ad. Subject lines about sale deadlines need to be accurate when sent.

What are the telephone solicitation hours in Washington?

GoHighLevel USA

RCW 80.36.390 bars solicitation calls received before 8 a.m. or after 8 p.m. at the recipient's local time. Washington is entirely on Pacific time, so our GoHighLevel agency Washington builds use a Pacific-time account with a daytime window on call steps.

Does the My Health My Data Act apply to med spas and clinics?

GoHighLevel USA

It can. The act covers consumer health data, including health inferences drawn from other information, and requires consent to collect or share it. Med spas, clinics and wellness apps often hold this kind of data, so we keep it out of general forms and marketing workflows.

Do you have an office in Washington?

GoHighLevel USA

No. GoHighLevel USA is a remote GoHighLevel agency Washington businesses hire online, and GoHighLevel is cloud software, so the build happens over video calls and shared screens. You can contact us to book a call that fits Pacific time.
